Terms and Conditions of Sale
Article 1 Purpose
The Terms and Conditions of Sale described hereafter set out the rights and obligations of the company, Kiwip Technologies SAS (registered in the Meaux trade and companies register under no. 818626293) and those of its customers arising from the online sale of Kiwip Technologies SAS products and services shown on its E-Commerce website: URL: www.kiwip.fr
Any service carried out by the company, Kiwip Technologies SAS, referred to hereinafter as “Kiwip” implies the full acceptance by the buyer of these Terms and Conditions.
Article 2 Presentation of Products
The essential characteristics of the products offered for sale are described on the specific product sheet published on our website. The photographs are not contractually binding. Kiwip cannot be held liable if errors are introduced on the website.
All the texts and images presented on the Kiwip website are reserved worldwide, under copyright and as intellectual property; their reproduction, even partial, is strictly prohibited.
Article 3 Validity period for the offers of sale
Products are offered for sale subject to availability of stock. In the event that a product becomes unavailable, the customer will be informed of this unavailability as soon as possible by email or post.
Article 4 Price of the product
The “Catalogue” section on our website displays the prices in euros. These prices include VAT but do not include delivery costs. The amount of VAT is specified when the customer selects a product and the delivery costs will appear on the screen after the customer’s selection.
Kiwip reserves the right to change its prices at any time, but a product is invoiced at the price shown when the order is recorded.
The prices indicated include any rebates and discounts that may be offered by Kiwip in accordance with its results or due to the fact that certain services are undertaken by the buyer.
No discount will be granted for early payment.
Article 5 Order
The customer confirms their order by clicking on the “Confirm your order” link at the bottom of the “Order Summary” page after having accepted the present Terms and Conditions. Before this acceptance, the customer is asked to verify each element of their order and therefore rectify any errors.
Kiwip confirms the order by electronic mail; this information includes all the elements of the order and the customer’s right to cancel the order.
The data recorded by Kiwip constitutes proof of the nature, content and date of the order. This data is archived by Kiwip under the legal conditions and deadlines; the customer can access these archives by contacting the Customer Service department.
Article 6 Payment methods
Payment for orders is made by bank card or SEPA direct debit.
Once the order is recorded, the buyer must pay the totality of the purchase price of the product or service chosen by the customer in the catalogue.
Article 7 Period of withdrawal
The Buyer has a period of fourteen clear days, from receipt of the purchased goods, to exercise their right of withdrawal without incurring any penalties; except for return costs.
If this time limit of fourteen days expires on a Saturday, Sunday, public holiday or non-working day, it will be extended to the next working day.
In case of exercising the right to withdrawal, the Buyer undertakes to return the complete goods in their original packaging, together with their wish to exercise the right of withdrawal in writing, by recorded delivery with acknowledgement of receipt.
The company shall refund the Buyer the full amount paid as soon as possible, and no later than fourteen days after the date on which the goods were received by the Company.
Article 8 Late payment (clause applicable to professionals)
In case of total or partial late payment of the goods delivered on the day of delivery, the Buyer shall pay Kiwip a late payment penalty equal to one and a half times the legal interest rate.
The applicable legal interest rate shall be the one in force on the day of delivery of the goods.
This penalty shall be calculated on the outstanding amount including all taxes and shall run as of the date the payment is due without any prior notice being required.
Pursuant to Articles L.441-6 and D. 441-5 of the French Commercial Law, any delay in payment, in addition to the late penalties, shall give rise to the payment of fixed compensation of €40 for recovery costs.
Additional compensation may be claimed, on the production of supporting documents, if the recovery costs incurred are higher than the fixed compensation paid out.
Article 9 Delivery
Goods are delivered with no guarantees concerning delivery times, with the exception of deliveries to private customers. Delivery times may vary depending on the destination. For a destination in mainland France, it is fixed on the day of payment + 8 days, and for other destinations on the day of payment + 1 month.
Article 10 Recycling
Kiwip offers, in accordance with the Environmental Code, a 1 for 1 take-back solution, that is, we can take back the used appliance with the purchase of the new equivalent equipment:
Art R543-180 of the Code of the Environment:
“I. – In the case of the sale of household electrical or electronic equipment, the distributor, including in the case of distance selling, shall take back free of charge or take back, on his behalf, used electrical and electronic equipment from which the consumer discards himself, within the limit of the quantity and type of equipment sold. ”
“III. – The consumer is informed of the conditions of recovery set up in application of I and II of this article, systematically and in a visible and easily accessible way. This information must be given to him before the deed of sale for the recovery referred to in I of this article. ”
Restart Order of October 8, 2014 – Article 1: For the free return of electrical and electronic equipment required by Article R. 543-180-I, the distributor must offer the consumer systematically and visibly and easily accessible At least the following solutions:
In the case of removal, at the point of sale, of the equipment sold: take back the used equipment at the point of sale.
In the event of delivery of the equipment sold at its place of use: take back of the used equipment on this place during the delivery.
In case of delivery to another place or in other ways: take back of the used equipment to the place of delivery; or a proximity collection system that the distributor finances and organizes or has organized, which may, where appropriate, include the distributor’s stores; or provision of a return solution via a postal service or equivalent service for electrical and electronic equipment, the characteristics of which permit it. ”

Article 11 Customer Relations – After-sales service
For any information, question or complaint, the customer can contact the Customer Service department at Kiwip from Monday to Friday between 09.00 and 18.00.
